How Much Do Lawyers Charge?

Legal services are expensive. If you need to help from lawyers, you should know how they charge. You also need to consider court fees. What do you do if you cant afford a lawyer?

If you plan to talk to your potential lawyers, you should ask them to explain their legal costs and billing practices. Your potential lawyers should be willing to explain their legal costs. Do not feel embarrassed.

Hourly rates, Flat fees, Retainers, and Contingent fees are common legal arrangements. How much is an hourly rate? It depends on his operating costs and experience. You need to shop around. However, cheaper is not always better. You want an experienced attorney.

Sometimes a lawyer may ask for a flat fee. You should know what that fee will and will not cover. For instance, filing fees may be excluded from the flat fee.

A retainer fee is an advance payment for a specific case, and it is usually non-refundable. If you drop a case, you usually forfeit the rest of your retainer fee.

Some lawyers charge by Contingent Fees. In simple English, they will not charge fee from the client, but they will get a percentage. Contingent Fees are usually about one-third of the settlement.

Court costs can add up quickly. You should discuss with your lawyer about miscellaneous court fees.

You should ask your lawyer for a fee agreement in writing. If your lawyer refuses, you might want to look for a new lawyer. Some states require written fee agreements.

If you cannot afford a lawyer for serious offense, you may ask for an attorney to represent you for free.

Michael Moore: It is Your Prescription for America that is "Sicko"

Occasionally, someone of influence brings forth an idea that is so moronic that I have to deviate from the discussion of pure finance, economics or market movements and just rant. Based on his recent antics and promotion of his upcoming socialist agenda train wreck titled Sicko, wed be better off living in Cuba and letting the government manage our healthcare.

Of the themes Michael Moore has espoused during his recent promotional tours, the most egregious is that "America's health care system should be regulated like fire and police departments because its that important".

At a press conference before the California Senate Health Committee, Moore said Im pushing for three simple things:

1. Health care for every American and person residing in this country, 2. Remove the profit making insurance companies from the equation, and 3. I want the pharmaceutical companies strictly regulated like a public utility.

Regarding point #1 - Michael Moore rightly highlights the plights of everyday people who don't have adequate access to healthcare. This is certainly unfortunate; I can't imagine not being able to get my children the health care they need. But nothing is free in this world, someone pays. In this free market that is America, citizens strive to work for a renowned company with solid health benefits. If their employer doesn't offer adequate health benefits, they're free to seek employment with a company that does. If their skills are not commensurate with this type of accoutrement, they have opportunities to improve their skill sets via the best secondary eduction system in the world. This is perhaps an oversimplification, but moves to FORCE employers to fund health care are inappropriate intrusions on free market forces, especially on small and mid-size businesses. A fair number of these uninsured at the Walmarts and other low-cost employers of the world are younger workers covered under their parents' plans or are adults under a spouse's plan. I'm a shareholder in a lot of companies that may not offer health benefits that their employees find to be suitable. Should I have to fund their healthcare through my investment holdings in broad market index funds? I don't see how this is a government mandate that is appropriate, whereas worker safety and harrassment policies, etc. are appropriate.

There are safety nets in this country for the disabled, infirmed and impoverished. I'm sure gaps exist that will appear in the movie and my heart goes out to those people who can't get the same care that is available to my family, but the system is working for the vast majority of legal citizens. In fact, it services a substantial population of illigal residents; I will be interested to see how Mr. Moore proposes the "government" services the current 12-20 million illegal residents (with hundreds of thousands per year still crossing the Mexican border each year - and accelerating with talk of amnesty). As it stands now, any citizen is generally provided emergency service without having to provide insurance or personal identification. Again, there are exceptions, and I'm sure they're highlighted in the movie, like when a man has to chose between which severed finger to keep based on the additional cost to bring in a special surgical team from another locale.

Regarding some other countries Mr. Moore praises, France may supply their constituents with guaranteed 35-hour workweeks, lifelong employment and free access to healthcare, but their unemployment rate is double what it is in America. Do you know how hard it is to start a business in France? Do you know how much sleep an employer loses over hiring an employee there? No matter how bad they are, it will be next to impossible to dismiss them. As evidenced by the recent riots throughout the countryside, France isn't exactly paradise either - class distinctions exist there. There is no perfect solution that will satisfy everyone.

Cuba...that's an entirely different world. Without delving into the obvious, the pristine hospitals and convenient Rxs dispensed for pennies were certainly not representative of the type of treatment available to routine citizens in Cuba. Cuban dissident groups and journalists that have been to Cuba have reported horrid conditions in hospitals and sub-par health care in general. Was the visit to the locale in the film completely random? Would it have made the cut for the movie if the conditions weren't so immaculate? I don't know; perhaps after the movie, more will surface on this detail like some past documentaries.

Regarding Mr. Moore's affinity for Cuba, attached are some sentiments from the CIA Factbook:

"Current situation: Cuba is a source country for women and children trafficked for the purposes of sexual exploitation and forced child labor; Cuba is a major destination for sex tourism, which largely caters to European, Canadian, and Latin American tourists and involves large numbers of minors; there are reports that Cuban women have been trafficked to Mexico for sexual exploitation; forced labor victims also include children coerced into working in commercial agriculture.

Tier rating: Tier 3 - Cuba does not fully comply with the minimum standards for the elimination of trafficking and is not making significant efforts to do so."

Way to go, Mr. Moore, in glorifying this wonderful Utopia!

Regarding point #2 - The insurance companies are an easy target in today's world of denied claims, Katrina stories and the like. The current health insurance system isn't perfect, but to suggest turning it over to the government is like forcing UPS and FedEx to yield to the U.S. Postal Service. While these entrepreneurial services are able to deliver our packages quickly, inexpensively and intact, the U.S. postal service continues to raise costs annually, use tax-payer dollars to advertise their services to compete, and still come up with abysmal performance. I see the man in brown running, literally, running back and forth to his truck with packages. I like our local postal delivery guy, but come on, have you ever seen a postal worker hustle like that? The amount of corruption, theft, bureaucracy and ineptitude routinely exhibited and tolerated within the ranks of government agencies is no panacea. Ever hear the phrase "good enough for government work"? Lifelong employment and full pensions by government run institutions are no match for the public sector in terms of competitive performance. Nothing against government workers individually; I have several in my family, but as a system, the performance of government agencies is abhorrent. Talk about special interests? How about the earmarks and pork spending that our government engages in? In my company, people are shown the door for unethical behavior and conflicts of interest. What happens in government? I'll take free market competition and industry any day.

Point #3 is especially concerning - When I hear people start talking about usurping free market principles, it's on par with altering the Constitution to me. Free market competition, the risk of failure and allure of rewards for risk-taking innovative behaviors is what made this country great.

The age-old cliche call for selling drugs at cost is juvenile and wrongheaded, but surprisingly, it piques the interest of politicians and populous alike because it sounds like something for free. What I don't hear is that Microsoft should have to sell versions of Vista for the dollar it costs to transfer the code to a CD or for your local cable company to offer you programming, internet and phone for the pennies it costs to transmit the data now that their infrastructure has been deployed. These are Multi-BILLION dollar investments in capital expenditures and human resources that are developed and deployed AT RISK. The only reason corporations assume this level of catastrophic level of risk is that the net present value of all their portfolio investments is positive, inclusive of research, development, and failures.

Consider Pfizer: It spent around $800 million to develop torcetrapib, only to drop it due to safety issues that arose in late stage clinical trials. This is the nature of the pharmaceutical business. This $800 million dollar loss and the hundreds of other new drug entities that are dropped along the way need to be offset by significant profit margins for the few drugs that actually do make it through the increasingly complex regulatory regiment. Does Mr. Moore actually expect that these companies should first assume these losses ad naseum and then for the few drugs that make it through, sell them at cost?

What is the assured outcome of this arrangement? The end of innovation. This is a recipe for perennial negative earnings and the eventual demise of the industry. The development of new cures and vaccines for new therapeutic categories will cease, for there is no profit motive. My lineage has particular maladies that I'd like to see my children avoid. If the innovation engine in this country (and hence, world) is ceased and new, innovative medicines are no longer sought and developed, my children will suffer same ailments as my ancestors. Mr. Moore will have us kill the next cure for Alzheimers, Parkinsons, Malaria, Hepatitis C...for HIV.

Consider what happened to the worldwide vaccine business over the past few decades. In 1988, there were 25 manufacturers. Currently, there are 4 primary ones left. Following years of litigation, misplaced injury claims and a general lack of profit motive (making one dose for life per patient vs. a lifetime of daily tablet treatments for chronic patients is a no-brainer from a profit margin standpoint, especially when considering the litigation environment), the vast majority of the existing companies exited the business to pursue higher margin new drug entities. Only now that some stability has set in, are companies returning to the business. If the same were to happen for all pharmaceuticals and biologics, innovation as we know it is over.

What concerns me about Mr. Moore taking a wrecking ball to the industry (disclosure - I work in the industry incidentally) is that this intellectual property and innovation is one of the last bastions of hope for our economy. Most low-complexity manufacturing has left our borders. Not only are these jobs being outsourced to areas that can perform the functions more efficiently, but our service industries will continue to fall prey to outsourcing as well. India has amassed X-Ray technicians to read charts throughout the night and accountants to process tax returns. Korean schools are teaching 3rd graders English at night after their full day of U.S.-beating Korean curriculum. The cultures have young, ambitious people that want what we have and they're willing to work harder for it! In the future, will we really need U.S. based financial analysts, consultants and other service industries we take for granted here? The day we give up on innovating new products here in the U.S., we continue an alarming trend that we will not be able to reverse.

What is likely omitted from the movie is the patient assistance programs whereby most pharmaceuticals provide free or cheap drugs to U.S. citizens without the means to pay for them. I've seen multiple pharmaceutical companies actually advertise this in print and on television. Of course, there are the tax and public relations benefits, but certainly, it's not improving the bottom line by giving away your product.

Tony Blair put it best when he said a good measure of a country is how many people want in compared to how many want out. The last time I checked, Floridian natives weren't risking their lives to sail to Cuba. Countless Cubans have lost their lives attempting to reach our shores. Mr. Moore, everyone in the world wants to come to America!

I have relatives in Canada that are ashamed of their socialist leadership and lifestyle. Is it worth having free health care when you have to wait weeks to see a doctor (the doctor prescribed to you, not the one you pick)?

So, where is Mr. Moore on other worldly issues:

The genocide in Darfur? 500,000 and counting.

The MILLIONS of children that die annually from vaccine-preventable diseases? 2.5 Million per year and counting. Our legal system that mandates three-strike sentencing for a man stealing a bike or peddling some pot to spend life in prison, while child molesters with excessively high rates of recidivism simply have to voluntarily register for a list with an unacceptably low rate of compliance?

Drunk Drivers - True Story - A few years back, a drunk driver travelling at an excessive rate of speed slammed into my wife's car at a stop sign from behind with our son in the back. Both cars were totalled and my wife and son were ushered to the emergency room (ironically, the drunk driver is almost never injured in such accidents). We soon learned from the responding officer that this driver had another DWI accident within the same month but was still driving legally; this had been his 5th such incident! He hit them at NOON on the way to test-drive a motorcycle of all things. It gets better. Months later, in order to perform her civic duty, my wife went to a hearing to testify about the accident and help ensure he was sentenced appropriately. Following the hearing, we watched him get in a different car and drive away. Incredulous, we asked the corresponding officer how he could possibly be driving legally. She said she ran his plates and confirmed that at that time, he was in fact still driving legally. This is how slow the system was. In 2006, about 18,000 people were killed in alcohol related accidents. Motor vehicle crashes are the leading cause of death for children 2 to 14 years old. Enough is enough! Where is Mr. Moore on this?

On the left: The lack of diversity of thought within America's universities where only liberal views are espoused to impressionable college students? Professors (especially non-tenured) best not vocalize a conservative thought in public, while the liberal treatises abound. Some statistics from a recent study by George Mason University: "72 percent of those teaching at American universities and colleges are liberal and 15 percent are conservative...the disparity is even more pronounced at the most elite schools, where, according to the study, 87 percent of faculty are liberal and 13 percent are conservative." Where is Mr. Moore on this disparity?

On the right: The chokehold that that religious right has on the Republican party. What does religion have to do with the governing of this great country? I'm concerned about the influence a faith has on the power structure in this country. Some of Bush's statements interweaving faith and the invasion of Iraq didn't sit well with me as I'm sure they didn't overseas. At least we know where Mr. Moore was on Iraq, but how about religion and politics in this country as a movie?

I have to say this about Michael Moore. I was listening to him on Howard Stern the other day. He is actually an affable guy in interviews and I think he really believes in what he's doing. I do think he loves America and wants to see it do better. I just think he's wrong. He did anonymously contribute $12,000 to an anti-Moore blogger whose wife couldn't afford her insurance premiums. I'm not the first person to say this, but Americans need to take more personal responsibility for their own health, Mr. Moore included, by the looks of him (Congratulations on losing 30 pounds recently though). We live in a country where people are eating themselves to death while a large portion of the world is malnourished. Regarding his proposals, what he has prescribed for our country's healthcare system is simply Un-American.

Case Study: Reno & Cavanaugh Redefines the Law Firm Work Culture

When most people think of a law firm, they do not think of a workplace with a great deal of flexibility built in for its attorneys, paralegals and support staff. In fact, most people, including those in the industry, picture a work/life balance that tips heavily toward the work side, with billable hours being the primary goal.

Yet, most law firms are not Reno & Cavanaugh, PLLC. In recent years the 30-year-old Washington, DC-based firm, which focuses on housing and community development law, has worked to translate the concept of flexible scheduling from a conceivable practice to a readily used, highly visible one. For instance, Paralegal Barbara Walder, who will celebrate her eleventh anniversary with the firm next month, is able to determine what time she arrives and leaves each day as long as her allocated hours are completed. Where I live, we dont have a true bus schedule, she says. So during daylight savings time Im able to change my hours to suit my bus schedule in order for me to get home at a reasonable hour.

Managing Member Megan Glasheen, named a 2006 Best Boss by Winning Workplaces, deserves much of the credit for Reno & Cavanaughs transition to a flexible work culture. Seven years ago, when her daughter, Simone, was born, Glasheen experienced firsthand the challenge of balancing work and personal life. Realizing that her struggle was not unique, she worked with her partners and staff to increase flexibility without sacrificing quality. Theres a real effort for everybody to be treated equally, to be listened to and respected and to be engaged in the office, and that makes a big difference, says Jaime Lee, a four-year veteran of the firm who became a partner this month.

Glasheen is excited about Lees promotion, both in terms of how it will affect Lees career and how it helps the firm retain good talent a danger area right now in the practice of law. People are leaving law firms in droves, Glasheen says. I think the takeaway from what were doing is that you can have a good work environment and still be a profitable business, and that it makes sense for the bottom line because it retains people.

What else is the firm doing to help its workers succeed? For one, it features a changing roster of operational decision-making committees which are each staffed with employees at all levels, from administrative support staff to senior partners. Martin Walsh, an associate and three-year veteran of Reno & Cavanaugh, is on the steering committee this year and was on several committees last year. I think its valuable to have the committees in place to allow ideas to flow freely between staff, attorneys and partners, and to then allow the decision makers to make the most well-informed decision, he says.

Reno & Cavanaugh also uses upward feedback surveys an uncommon measure, especially among law firms. As is the case with many best practices, top-down support was necessary for these surveys to be effective. In other words, the firms partners needed to be able to accept feedback from the staff that supports them. Luckily, Glasheen says, that wasnt a problem. Im blessed with incredible partners, and were all on the same page in terms of having an inclusive workplace and recognizing that we all collectively have things that we need to work on, she says.

Lee finds the surveys, which include a personalized annual goals document, somewhat time consuming but ultimately useful, especially in terms of seeing why goals are unmet or dropped over the course of a year and evaluating their feasibility in moving forward. She also thinks upward feedback surveys can become more helpful the longer an employee is with the firm. When youve been at a place for a while, you can lose sight of how your decisions trickle down to everyone else, so its good to have that check in place, she says.

Beyond the measures that Reno & Cavanaugh has in place to foster happy, productive employees, Leighton believes that the firms mission to choose to practice types of law that other firms might shy away from including community development block grants, low-income housing tax credit programs and moving-to-work issues ensures that the right people get on board with the right focus. Its funny unlike other law firms, where they might be asking, How can we squeeze more dollars out of this particular contract? we sit around talking about how we can save the client money, he says.

Lee, the firms newest partner, wouldnt have it any other way. As part of a group of employees that Reno & Cavanaugh hired just before it underwent a growth spurt, she said she and her colleagues have enjoyed watching it grow while the leadership has found new ways to respect workers needs. I get lots of calls from recruiters, but Ive never thought of leaving, she says.

Weight Gaining Diet - All You Need To Know

Are you looking at gaining some serious mass? Well this article is going to take you through how to do this and show you how to gain quality mass rather than just fat!

Its really important how many calories you are taking in when trying to bulk up so you must set an eating plan and stick to it as you can easily lose track of your food. What you need to determine is how much carbohydrates, protein and fats should you be getting from your diet. A very popular ratio is a 50/30/20 ratio where you are in taking 50% carbohydrates, 30% protein and 20% fats in your diet. As far as the calories go you need to be taking in more calories then you are burning off. If you are not then obviously you are going to be losing weight no matter what!

A good starting method with your diet is to track your calories for a couple of weeks which involves writing down everything that you have eaten within that time period. You then need to determine the calories of each meal and find out the average number of calories you are consuming per day. Once you find out the average calories you have been consuming you are going to add 300-500 calories to your current diet for the first two weeks. For the next at least 8 weeks you are going to add 300 calories to your daily intake each week.

As far as how often you should be eating it really depends on how fast your metabolism is. If you have a really fast metabolism then you should eat every 2 to 3 hours so that all your fuel isnt being burnt so quickly.

Carbohydrates -

Carbohydrates are essential for energy in your diet and you need a lot of carbohydrates as stated earlier, up to 50% of your diet must consist of carbs. For the weight gaining diet there are two types of carbohydrates you will be consuming, simple and complex carbs. You should only eat simple carbs which consist of sugars/dextrose after your workout only as they will provide a large insulin spike in your body and this can cause you to store more fat. Complex carbohydrates on the other hand are great for bulking because the energy is released slowly into your body and do not create a spike. Therefore you will focus your diet on more complex carbohydrates.

Rights of Passage or Permanent Adolescence

Puer Aeternus is Latin for eternal boy. Senex is Latin for old man. However, this is just one archetype--a split archetype. Hillman (1970) explains "that the senex is a complicatio of the puer, infolded into puer structure, so that puer events are complicated by a senex background." (p. 146). Explaining that the senex has a double nature, Hillman continues by saying "one characteristic is never safe from inversion into its opposite" (p. 148). So what? How does all this double talk relate to the real world?

Since a thorough examination of the puer is usually incomplete without discussing its senex counterpart, for the sake of brevity and focus, the senex will not be discussed further. The puer will be the focus.

Having been an inveterate alcoholic/drug addict for more than 30 years of my life, those years can be juxtaposed with the problem of the puer aeternus. I went to a party when I was 11 and didn't get back until I was, ad extremum--at last, 43 years old. Indeed, the puer was alive and well in me. Having spent time in the Augean stables of county jails and ultimately the state penitentiary, I noticed that the puer population was alive and well in there too--a virtual pied-a- terre.

Kipnis (1999) reports studies done by the Prison Activist Resource Center that lists the top ten reasons for Californians entering prison today:
1.Possession of a controlled substance
2.Possession of a controlled substance for sale
3.Robbery
4.Sale of a controlled substance
5.Second-degree burglary
6.Assault with a deadly weapon
7.Driving under the influence
8.First-degree burglary
9.Petty theft with a prior conviction
10.Vehicle theft

Most inmates are imprisoned for substance-related offenses (p. 176). Kipnis reminds us that drug offenders represent sixty percent of federal prisoners and over one-third of state and county prisoners (p. 121). These statistics do not include the inmates who are intra muros--within the walls, because of malesuada fames--hunger that urges people to crime: crimes committed to finance drug and alcohol use, or crimes committed while under the influence, etc. In the netherworld of the prison yard, I found that most inmates were much like me in many ways-- quite comparable to the scabrous characters whom I associated with on the streets.

Marie-Louise von Franz (2000) describes me (the puer) as having an

arrogant attitude toward other people due to both an inferiority complex and false feelings of superiority. Such people also usually have great difficulty in finding the right kind of job, for whatever they find is never quite right or quite what they wanted. There is always 'a hair in the soup' (p. 8).

Lionel Corbett (1997), when addressing narcissism, writes that "pathological grandiosity which is needed to maintain a fragile self structure may make one depreciate the religious values of other people for the sake of self enhancement (p. 34). Not only toward religious values, I might add, but toward any values unlike their own.

Me and my puerile friends were often, to say the least, irresponsible. I am reminded of the time, under the influence of methamphetamine, I was digging holes in the desert at an old dump site. I was so preoccupied with this frivolous activity that I made a conscious decision to not go to court on a Failure to Appear charge. The Peter Pan in me wanted to play instead--trahit sua quemque voluptas, each man's fancy lures him. According to Kiley (1983)

Victims of the Peter Pan Syndrome can't escape irresponsibility. This trap begins as innocent, typical rebellion, but mushrooms into an adult lifestyle. A fundamental piece of the puzzle of the Peter Pan Syndrome is gross irresponsibility that spawns ineptness in basic self-care skills (p. 45).

Irresponsibility, a false sense of superiority, going from job to job, not bathing for a week at a time, and a penchant for blandae mendacia linguae--the lies of a smooth tongue, and building air castles are only some of the quotidian traits of the puer aeternus. This is not to say that puertraits are all negative. Gauche as the puer is, he is usually very affable, sanguine, well- intentioned, and good-natured. Many of his often subtle senex attributes also enhance the positive puer. His firebrand presence on prison yards, however, and his chemical dependency further exacerbates the plight of the negative puer. So, how might we account for such vast numbers of people in this country caught in the problem of the puer aeternus? One popular theory is that American youth are virtually without formal rites of passage--hoc opus, this is the difficulty.

To ignore rites of passage or dismiss them as trivial or unnecessary rituals is ridiculous as denial being a river in Africa. Gleaned from The Stanton Peele Addiction Web Site, it is stated that

in a 1980 article in the American Sociological Review and a 1984 article in the Journal of Studies on Alcohol, where two sociologists at the University of Syracuse, Barry Glassner and Bruce Berg, investigating Jewish drinking in a large upstate New York city because they believed that traditionally low Jewish alcoholism rates had increased over the years. Of the Jewish people the sociologists actually interviewed, none had ever had a drinking problem. Investigating all reports by activists in the Jewish community who had announced a growing alcoholism problem, Glassner and Berg could not actually locate one Jewish alcoholic. Accepting at face values all such reports led to calculation of an alcoholism rate of about one-tenth of one percent among Jewish adults.

Wow! Could it be that a bar mitzvah is responsible for this? Probably--at least where drugs and alcohol are concerned. However, judging by reports from the Jewish community, they do have other addictions such as overeating and anorexia. According to the National "Jewish Press," Ross (April, 1986) reports that there are seven to 10 thousand Jewish inmates in the United States. That is not very many compared to the two million Americans that Kipnis (1999) reports who are behind bars (p. 170). Under the aegis of the church, could initiatory rites of passage account for the absence of the puer in Jewish culture? If so, one could be compelled to investigate rites of passage in other cultures.

"The term initiation," as defined by Eliade (1958) "in the most general sense denotes a body of rites and oral teachings whose purpose is to produce a decisive alteration in the religious and social status of the person to be initiated" (p. x). The closest I came to being elevated from a child to something more than a child, was my entrance into junior high school. Without so much as a caveat from the elementary school level, what followed came as a radical social change. In what seems now like an almost overnight transformation, I went from a pleasant grade school boy to a acerbic junior high school rebel without a cause: from playing on the monkey bars to getting drunk at Friday night football games; from wrestling with schoolmates on the playground to gang fights with rival Mexican gangs after school--riotous, no doubt, as the Germanic berserkers of antiquity; from playing hide-and-go-seek with girls to whisking them out of the movie theater to kiss and fondle them--not unlike Theseus carrying off Adriadne (p. 109); from recess to smoking in the bath rooms during breaks; from evenings home with parents to malicious mischief with friends. It could be argued that there is a nexus between our malicious mischief and the spirit of initiation. My friends and I felt compelled to prove ourselves to each other, so we acted-out an incredible amount of destructive behavior in the process. This alchemical coniunctio, from boy to wacko, also involved more subtle anomalies. Discussing initiation in Tierra del Fuego, Eliade mentions that "a frequent custom is that of giving the novice a new name immediately after his initiation (p. 28). Soon after my nascent arrival into junior high school, one of my new friends tagged me with the name Little Richard. I remained Little Richard for the rest of my first life. My first life being my drug and alcohol years; my second life being my post drug and alcohol years; my pre life being a rather short childhood.

The closest I came to a formal initiation ceremony during puberty was my sixth grade graduation ceremony, elevating me to junior high school status. This happened at about the same age as the bar mitzvah does in Jewish culture. Being unfamiliar with the bar mitzvah and what their ordeals entail, I believe it is safe to assume that there are painstaking lengths gone to for some kind of enduring conversion. Eliade (1958) says that among the Australian Yuin tribe "the first initiation ceremony, comprising the separation from the women and the ordeal by fire, is thus complete. From that night on the novices share only in the life of the men"( p.8). Indeed, the elevation to junior high school with its incumbent social status, seemed to suddenly sever an emotional attachment to my mother, and created a different kind of emotional attachment to my newly acquired friends--friends, I might add, some of whom I kept for more than 30 years. In discussing "the secret society of the Bakhimba in Mayombe," Eliade shares that "the initiatory ordeals continue from two to five years (p. 75).

When considering my adolescence, I could say that my initiatory ordeals, or rather my initiatory gradations, also continued for years; thereby eventuating the problem of the puer aeternus. After my elevation to junior high, I could not bear the interminable passage of time to arrive at Xvarnah--that light of glory that the magical age of 16 brings, when that golden driver license can be attained. I took a driver education class at 15 and a half and avoided the 16-year- old driver license requirement by legalizing my driving privilege with an instruction permit. This legal manipulation empowered me to drive a car if I had a licensed driver in the car with me. It also empowered me to drive a motor-driven cycle without any supervision; therefore, I talked my parents into allowing me to spend my savings on a Cushman Eagle motor scooter. Wa la, I attained independent mobility. Not only did my social status go up another notch, but my mobility put me in contact with the higher echelons of the streets. The Los Diablos motorcycle gang even took me under their wing. I had arrived! My blissful state of Xvarnah, however, was short-lived. Two weeks later I was arrested and jailed for curfew. Two weeks after that I got my first of seven DUI's. Ironically, in another two weeks, a friend and I were arrested for stealing milk off a porch after staying out all night drinking. Consequently, my dad took away the motor scooter and I found myself immobile and distraught.

Can my entrance into junior high school be considered a rite of passage? Can my driving privilege be considered a rite of passage? Probably not--at least not in the traditional sense. However, it is my contention that these were different kinds of rites of passage. Not having adequate formal guidance--I guided myself, which is common, and has been for a long time. The lack of parental control, of course, exacerbates the situation.

Eliade (1958) says that

even if the initiatory character of these ordeals is not apprehended as such, it remains true nonetheless that man becomes himself only after having solved a series of desperately difficult and even dangerous situations; that is, after having undergone 'tortures' and 'death,' followed by an awakening to another life, qualitatively different because regenerated" (p. 128).

By the time I was socially established in junior high school, I had been through various tortures and been awakened into another life by suffering with hangovers, sporting black eyes and bruises from fighting, getting in scooter and car accidents, enduring punishment for indiscretions at school, and continually having to endure the wrath and retribution of my officious parents for my refractory behavior. It could be said that I was tortured when I was metamorphosed from the archetypal innocence of a butterfly into a nasty old caterpillar (etymologically cater comes from tomcat and pillar comes from plunderer). By the time the caterpillar summer was over, my heterodox lifestyle had been firmly established. This new and parlous life--this self will run riot, continued until I was 43 years old. Graduating from high school and turning 18, then turning 21 were still further entrenchments, but they were really gradatory inevitabilities compared with the junior high school awakening that established an eonian lifestyle. I did not experience rites of passage in the way they were experienced in the mystery religions or in any other traditional way.

"Modern man," explains Eliade (1958)

no longer has any initiation of the traditional type. Certain initiatory themes survive in Christianity; but the various Christian denominations no longer regard them as possessing the values of initiation. The rituals, imagery, and terminology borrowed from the mysteries of late antiquity have lost their initiatory aura" (p. 132).

However, there is a more formal movement of initiation going on in society today under the guise of another name--hazing.

At a web site sponsored by Education Week, Walsh (September 6, 2000) reports that

almost half the high school students responding to a national survey said they had been subjected to activities that fit a broad definition of hazing to become members of sports teams, cheerleading squads, gangs, and other groups. The study by researchers at Alfred University in New York, released last week, is described as the first serious academic research into initiation rites at the high school level. Some of the results surprised even the authors. For example, the survey showed that 24 percent of students joining youth church groups faced hazing. The study's authors, expecting little hazing in that category, almost didn't include it in the survey. Among all survey respondents, nearly one out of four students was required to engage in substance abuse, such as participating in drinking contests. And 22 percent were subjected to activities the researchers defined as dangerous hazing not involving substance abuse, such as stealing, inflicting pain on themselves, or being physically abused.

Drinking contests, daredevil fighting, stealing to fit in, etc., were the callow activities I participated in during my pubescence--a temporary modus operandi that I consider initiatory, even though I wasn't being forced to do it. If I hadn't, however, then I would have been alienated or suffered some other type of consequences. Durkheim (1995), discussing tattooing, states that "it is true that, among the Arunta, the design thus made does not always and necessarily represent the totem of the novice" (p. 116). It astonishes me today that I willingly endured such excruciating pain incurred from tattooing, macho-acting as though it wasn't painful at all. I now consider this non compos mentis--not of sound mind. Durkheim, however, shares that "Preuss was the first to become aware of the religious role that is ascribed to pain in the lower societies" (p. 317). Of course we did not conceive ourselves as doing anything religious or even spiritual, but our tattoos were always symbolic to the interests of our group.

Walsh's article went on to describe in detail the various forms of hazing that I am not inclined to include here. The original study he quotes from is available at the previously mentioned web site.

Conclusion:

Obviously, our youth in this country is now, and has for a long time been ripe for some kind of formal rites of passage, and since we don't seem to feel it is necessary to incorporate it into our culture--they are. Like solicitous parents, we should take heed of magnum bonum--the great good, of the bar mitzvah in the Jewish community and do a commensurate service to our pubescent population by supplanting independent hazing practices. This may be too idealistic. Such an achievement would, indeed, be a pyrrhic victory. Whether it is hazing, addiction, or any type of aberrant behavior, most of us know that what we're doing is not conducive to a productive life--video meliora proboque, deteriora sequor, I see the better course of action and I approve of it, but I follow the worse course. Here is a parable to this Latin phrase.

"According to Webster's Dictionary," says Ellis (1985)

mumpsimus is an error obstinately clung to. The word comes from the story of an old priest who, for thirty years, had conducted services using the word mumpsimus, a substitute for the correct Latin word sumpsimus. One day, when his error was finally pointed out to him, he replied, 'I will not change my old mumpsimus for your new sumpsimus.' (p. 106).

The bottom line: Without a significant rite of passage, much of our youth will remain adolescent in behavior and attitude far into adulthood--puer aeternus.

After 40 arrests, five formal probations, four country jail sentences, and a prison term (as a result of chemical dependency), I turned my life around. I was released from prison in Dec 1989, and have been clean and sober since. I started at Barstow College in Feb 1990. Received my AA degree in '92 from Barstow College in Barstow, CA; BA in '94 from Chapman University in Orange CA; MHS in 98 from National University in San Diego CA, and finished with a Ph.D. from Pacifica Graduate Institute in Santa Barbara, CA in Feb 2004. In an effort to prove this cure works, he utilized the protocols, and in six weeks lost 45 pounds. He also revealed in his infomercial that no exercise was needed; his energy level increased; and his eating habits drastically changed. Moreover, once you have completed the protocol outlined in the book, you will never feel hungry and your metabolism will increase, thereby allowing for more fat to be burned. If you have had the opportunity to see Mr. Trudeau in his infomercials, you will notice the dramatic change in his weight as well as take note of his youthful appearance.

If you have tried to lose weight and failed, you should read this book. Ensure you check with your doctor before trying any weight loss diet wherein you lose weight as rapidly as Mr. Trudeau claims. However, it is worth the price. It is also important to note that he has also tried other weight loss programs without success. He would lose the weight and gain it back.
